Paragon leveling my barb I disabled the sound so I could play my itunes. Started a new character so I enabled the sound so I could get the full experience again and fps go from 60 to 30. Disable sound back to 60 fps. I don't know how this makes any since at all but that's the story.

Can you post some information about your computer? You can find this information in the Direct X Diagnostic Tool:

Click on Start
Click on Run
Type in: dxdiag (In Vista, type dxdiag in the search field)
Hit Enter or OK

Click on the Save All Information button at the bottom, and create a dxdiag text file, and copy and paste it ALL here.

Could you also post your D3Prefs.txt file? It's located in the My Documents\Diablo III folder.

Try changing the number of sound channels to use to 16 or 32.

You can either make the change in the in-game menu for sound or edit the D3prefs file when the game is closed.

Edit this line

ChannelsToUse "128"

to

ChannelsToUse "16" or ChannelsToUse "32"

The premise is a higher number of sound channels may result in "better" sound but a lot of people have reported that the higher settings cause a performance drop. Myself, I can't tell the difference between the two, though I also don't see a performance drop between them either. I just leave mine on 16. It's worth seeing if it helps in your case or not.

Your hardware may be getting hit just enough by the extra load generated by the increased channels to cause it to not be able to maintain 60 fps which is what vsync being enabled is trying to do. You can also just disable vsync and you'll probably see a higher initial fps and it will also drop, maybe not as low as 30 but below 60. If you're using vsync and it can't maintain 60, it drops to 30.
